Consumer Health Data Privacy Notice

GAYBY, INC. | Effective date: November 6, 2026 | Last updated: November 6, 2026

This notice supplements our Privacy Policy for consumer health data protected by Washington’s My Health My Data Act, Nevada’s consumer health data law, and other applicable laws.

Information and purposes

Gayby does not ask for medical records, test results, or fertility or genetic history. The consumer health data we hold falls into three groups: what you tell us you are offering or looking for, such as sperm, eggs, carrying a pregnancy, or embryos; anything you choose to write about your health or reproductive plans in your bio, messages, reports, or support requests; and inferences our automated review tools draw from your profile photographs and biography. Your activity on the Service, such as the profiles you view or like, can also reveal an interest in reproductive services.

We obtain this information from you; from the profile, messaging, support, reporting, profile-review, and verification features through which you use the Service; and from providers supporting those features. We use relevant information to display the profile you choose to create, support discovery and messaging, provide requested features and support, conduct profile-review and verification workflows, and investigate reports. Additional uses require the permission or other legal basis applicable to them.

Disclosures

Consumer health data may be disclosed to other members when you place it in a visible profile or message. Providers supporting the Service, including hosting and storage, profile-review and verification, and communication providers, may process information necessary to perform their functions. These providers are Amazon Web Services and Cloudflare (hosting and delivery), Anthropic (profile review and verification), Twilio, SendGrid, and Expo (email, SMS, and notifications), and Apple and Google (notifications and app-store purchases). The Service also uses PostHog and Google Analytics, which receive records of activity in the Service such as profile views, likes, and matches. Gayby does not use consumer health data for third-party behavioral advertising.

Collection and sharing occur only with the consent required by law or within an applicable exception for providing a product or service you request. Where sharing requires consent, it is obtained separately from consent to collect. A general Terms acceptance is not that consent.

Your rights

Where these laws apply, you can request confirmation of collection, sharing or sale; access to protected data and recipient information; withdrawal of consent or cessation of processing; and deletion. Email [email protected] with “Health data request.” We verify requests using information reasonably needed for authentication and apply the deadlines and exceptions required by law. If we refuse a request, you may appeal to the same address using “Health data appeal.” We will explain our appeal decision and provide the appropriate attorney general complaint route if the appeal is denied. We will not unlawfully discriminate for exercising these rights.

Deleting consumer health data may prevent some Service features from working. We process deletion requests in accordance with applicable law, including any requirements to notify recipients or address backup copies. Contact GAYBY, INC. at the email or mailing address in the main Privacy Policy for assistance.
